Emma Brooks Design reserves the right to update these terms at any time. The version in effect at the time of purchase applies to that engagement. The latest version will always be available at emmabrooksdesign.com/terms.

11. Changes to these terms

These terms are governed by the laws of England and Wales. Any disputes that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Governing law

Emma Brooks Design provides strategic direction and advice in good faith based on the information provided. Outcomes are not guaranteed.

Emma Brooks Design's total liability in connection with any engagement shall not exceed the total fees paid by the client for that engagement.

Emma Brooks Design is not liable for any loss of revenue, loss of clients, or indirect or consequential losses arising from advice given or work produced.

9. Limitation of liability

If something goes wrong, please get in touch first. Most issues can be resolved quickly and directly via email at hello@emmabrooksdesign.com

If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing legal action.

8. Dispute resolution

Emma Brooks Design will treat all materials submitted by the client as confidential and will not share them with third parties without prior written consent.

The client acknowledges that any frameworks, tools, or proprietary methodologies shared by Emma Brooks Design during the engagement are confidential and may not be reproduced, shared, or sold without written permission.

7. Confidentiality

All strategic frameworks, methodologies, and proprietary concepts used or referenced during the engagement remain the intellectual property of Emma Brooks Design.

Work produced specifically for the client — including written feedback, direction documents, and strategic briefs — becomes the client's property upon receipt of full payment.

The client grants Emma Brooks Design permission to reference the engagement in general terms (for example, in a portfolio or case study) unless a written request for confidentiality is made before work begins.

6. Intellectual property

Retainer Hours are valid for 3 months from the date of purchase. Any unused hours after this date are forfeit and no refund will be issued.

If exceptional circumstances prevent you from using your hours within the 3-month window, please get in touch before the expiry date. Extensions are considered at the sole discretion of Emma Brooks Design and are not guaranteed.

Hours cannot be transferred to another person or held over indefinitely.

5. Expiry & forfeiture of hours

Due to the nature of strategic and consultancy services, all sales are final once work has commenced.

If you have purchased Retainer Hours and no work has begun
  •  meaning no materials have been submitted and no hours have been used 
  • you may request a full refund within 14 days of purchase by emailing hello@emmabrooksdesign.com

Once any hours have been used, no refund is available on those hours. Unused hours within the 3-month window are not refundable but remain available for use until expiry.

If Emma Brooks Design is unable to fulfil a confirmed engagement for any reason, a full refund will be issued for any unused portion of the work.

4. Refund policy

All prices are in pounds sterling (GBP) and are inclusive of any applicable taxes unless otherwise stated.

Payment is required in full before work begins. No work will be undertaken until cleared payment has been received.

For Retainer Hours, the full block of hours is payable at the point of purchase via Stripe. Work commences on the agreed date once payment is confirmed.

Emma Brooks Design reserves the right to pause or withhold work if payment is outstanding.

3. Payment terms

Emma Brooks Design provides strategic and creative direction. This includes brand strategy, positioning, messaging, and website direction.

Emma Brooks Design does not build websites, write copy for implementation, manage social media, or handle any form of technical execution. Where a brief or direction document is produced, implementation is the sole responsibility of the client and any third parties they engage.

The scope of each engagement is confirmed in writing before work begins — either via a scoped proposal, a confirmation email, or a Stripe purchase description. Work outside that agreed scope is not included and will require a separate agreement.
